Agreement to Terms

By accessing austinsidxcombinator.com or purchasing an IDX website subscription from Austin's IDX Combinator ("we," "us," or "our"), you agree to these Terms of Service. If you do not agree, please do not use our website or services.

Services

Austin's IDX Combinator provides custom-branded IDX websites for licensed real estate agents in Florida. Our service includes website setup, hosting, domain configuration, MLS data integration via Stellar MLS, and ongoing maintenance.

Eligibility

Our IDX website service is available to licensed real estate agents and brokerages who are members of a Multiple Listing Service (MLS) that Austin's IDX Combinator supports. You must be a licensed REALTOR® or real estate professional to display MLS listing data on your website, in compliance with MLS rules and regulations.

Subscription and Payment

  • Pricing: Current pricing is listed on our website. Prices are subject to change with 30 days' notice.
  • Billing: Subscriptions are billed monthly.
  • Cancellation: After the initial setup period, subscriptions are month-to-month. You may cancel at any time by contacting Austin. Your site will remain active through the end of your current billing period.
  • Refunds: Setup fees are non-refundable. Monthly subscription fees are non-refundable for the current billing period.

Your Responsibilities

As a subscriber, you agree to:

  • Provide accurate branding materials and business information
  • Maintain an active real estate license and MLS membership
  • Comply with all MLS rules regarding the display of listing data
  • Comply with all applicable real estate advertising laws and regulations
  • Not use the website for any unlawful purpose

MLS Data

Listing data displayed on your IDX website is sourced from Stellar MLS and is subject to Stellar MLS's terms, rules, and regulations. Austin's IDX Combinator does not guarantee the accuracy, completeness, or timeliness of MLS data. MLS data is provided for informational purposes and should be independently verified by consumers.

Intellectual Property

The IDX website platform, code, and underlying technology are the property of Austin's IDX Combinator. Your branding materials (logo, headshot, bio) remain your property. You are granted a non-exclusive license to use the platform for the duration of your subscription.

Limitation of Liability

Austin's IDX Combinator provides websites and hosting on an "as is" basis. We do not guarantee uninterrupted service, though we strive for maximum uptime. We are not liable for any indirect, incidental, or consequential damages arising from your use of our services, including but not limited to lost leads, missed sales, or business interruption.

Termination

We reserve the right to terminate your subscription if you violate these terms, fail to maintain a valid real estate license, or use the service for unlawful purposes. We will provide notice before termination when possible.

Governing Law

These terms are governed by the laws of the State of Florida. Any disputes will be resolved in the courts of Florida.

Changes to These Terms

We may update these terms from time to time. We will notify active subscribers of material changes via email. Continued use of our services after changes constitutes acceptance of the revised terms.
